Under the procedural guidance of the Podilsk District Prosecutor's Office of the city of Kyiv, one of the former executives of JSC «Ukrgazvydobuvannya» has been notified of suspicion of embezzlement of the company's funds during the procurement of diesel fuel, the Office of the General Prosecutor reports.

The suspect's actions are qualified under Part 5 of Art. 191 of the Criminal Code of Ukraine, namely as embezzlement of another's property through abuse of official position by an official, committed under martial law and on an especially large scale.
The General Prosecutor's Office claims that in May – June 2024, the suspect concluded and ensured the execution of a fuel supply contract at an inflated price. At the same time, by virtue of his position, he organizes and is responsible for the work of subordinate units regarding the monitoring of market prices for petroleum products. Thus, according to one of the fuel acceptance acts, due to the overstatement of the cost, they overpaid nearly UAH 1.1 million on a UAH 3.9 million deal, which amounts to 28.2%.
Based on the photo published by the prosecutor's office, it is likely regarding the ex-director for commercial affairs of UGV – Maksym Horbatiuk. According to an analysis of Prozorro data, the tender that the investigation might have been reviewing is UA-2024-02-20-001812-a (the procurement amount was UAH 202.27 million for 3.75 thousand tons of diesel fuel (average price of UAH 53,939/t) for each of the two lots, the winner and sole participant being «AT Energo Trade» LLC). According to NaftoRynok data, in May-June the cost of diesel fuel delivered to the Poltava region fluctuated and during that period amounted to UAH 44.48 - 45.09/l (UAH 53,269-54,000/t, density 0.835 kg/dm3).
The Office of the General Prosecutor reports that the issue of choosing a preventive measure for Horbatiuk is currently being decided. The pre-trial investigation is conducted by investigators of the Podilsk Police Department of the Main Directorate of the National Police in Kyiv, with operational support provided by officers of the Strategic Investigations Department in Kyiv of the Strategic Investigations Department of the National Police of Ukraine.
The General Prosecutor's Office emphasizes that in accordance with Art. 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in accordance with the law and established by a court's verdict of guilty.
